These Application Terms & Conditions (“Terms”) govern the submission of applications and use of recruitment and job placement services provided by Actus Consulting Group, Inc. (“Actus,” “we,” “us,” or “our”).
By submitting an application and accepting these Terms, applicants acknowledge and agree to the conditions described below.
1. Data Collection and Use
Actus collects personal information voluntarily provided by applicants, including contact information, resumes, employment history, education, professional qualifications, skills, and career preferences. Actus may also obtain relevant professional information from publicly available sources, including LinkedIn and job boards, for recruitment purposes.
This information is used to provide recruitment services, evaluate qualifications, match applicants with job opportunities, communicate regarding applications, and maintain recruitment records.
Applicants should not submit Social Security numbers, passport numbers, driver’s license numbers, bank account information, copies of identification documents, or other highly sensitive personal information through standard applications.
2. Sharing of Information and Service Providers
Actus will not share applicants’ resumes or personally identifiable information with prospective employers or clients without their prior consent.
Applicants may be contacted regarding potential opportunities and asked to authorize the submission of their information to a prospective employer.
Actus may share personal information with authorized service providers for recruitment and business operations, including Manatal, cloud storage, website analytics, email communications, and SMS providers. Information may also be disclosed when required by applicable law or lawful governmental request.
Authorized Actus personnel may access applicant information for legitimate recruitment purposes, subject to appropriate safeguards. Technology-assisted tools may support candidate searches and job matching. Recruitment decisions are subject to human review.
Sensitive demographic information, including race, gender, age, and ethnicity, is not used by Actus to score, rank, or evaluate candidates.
3. Data Retention
Actus generally retains applicant information for up to 48 months (4 years) from the most recent application or meaningful recruitment-related interaction, unless a deletion request is fulfilled earlier or a longer retention period applies.
Applicants may request deletion at any time. Where Actus has provided staffing, employment, placement, or related services, certain records must be retained for the periods required by applicable law. A deletion request does not override these legal obligations.
After the applicable mandatory retention period ends, Actus will take reasonable steps to securely delete or anonymize records requested for deletion, unless another lawful basis requires or permits continued retention. Other information will be deleted or anonymized when no longer needed, subject to applicable law.
4. Accuracy and Voluntary Application
Applicants agree to provide accurate, truthful, and current information. Applicants must not disclose nonpublic job or client information obtained through Actus without authorization, except as permitted by law, or knowingly interfere with recruitment processes.
Applicants are responsible for notifying Actus of material changes to their qualifications, contact information, or employment preferences.
Submitting an application does not guarantee an interview, job offer, placement, or employment. Actus may exercise discretion in determining suitable referrals and may not provide detailed reasons for individual referral decisions, except where disclosure is required by law.
Actus reserves the right to decline, suspend, or discontinue recruitment services where reasonably necessary, including when an applicant provides materially inaccurate information or violates these Terms, subject to applicable law. Actus may modify or temporarily interrupt recruitment services due to operational needs, system issues, or circumstances beyond its reasonable control, subject to applicable law and any separate employment obligations.
5. Access, Correction, and Deletion
Applicants may request access to, correction of, or deletion of their personal information at any time by contacting info@actus-usa.com.
Actus may verify the applicant’s identity and will process requests in accordance with applicable law. Deletion of records subject to mandatory retention requirements may be deferred until the applicable period ends, and other lawful retention exceptions may apply.
6. Non-Discrimination and Accessibility
Actus is committed to equal employment opportunity and does not discriminate in the provision of recruitment services on the basis of protected characteristics under applicable law.

7. Data Security and Sensitive Information
Actus implements reasonable administrative, technical, and organizational safeguards to protect applicant information.
Applicants should not include highly sensitive personal or financial information in resumes or standard applications.
Employment onboarding and related records, including Form I-9, payroll information, and background screening records where applicable, are collected and maintained separately from general recruitment records.
Although Actus maintains reasonable security measures, no electronic transmission or storage system can be guaranteed to be completely secure.
8. Privacy Policy
The collection, use, sharing, storage, and protection of personal information are further described in the Actus Privacy Policy, available on our website.
Applicants are encouraged to review the Privacy Policy before submitting an application.
Where applicable law provides privacy rights that cannot be waived, nothing in these Terms is intended to limit those rights.
9. Individual Arbitration and Class Action Waiver
To the extent permitted by applicable law, disputes arising from or relating to these Terms or Actus recruitment services shall be resolved through binding arbitration on an individual basis rather than through litigation in court.
To the extent permitted by applicable law, applicants and Actus agree that disputes subject to arbitration will be brought only in their individual capacities and not as plaintiffs or class members in any purported class, collective, or representative proceeding.
This provision does not apply to claims that cannot lawfully be subject to mandatory arbitration or to rights that cannot be waived under applicable law.
Nothing in this provision prevents applicants from filing charges or complaints with the Equal Employment Opportunity Commission (EEOC) or other governmental agencies, or from exercising rights protected by applicable law.
10. Governing Law, Liability, and General Provisions
These Terms are governed by applicable laws of the United States and the relevant state jurisdiction, without limiting any non-waivable rights or protections under applicable law.
Actus provides recruitment and job placement assistance but does not guarantee employment, compensation, job duties, or other terms offered by prospective employers.
Applicants are responsible for reviewing and confirming employment conditions directly with prospective employers before accepting an offer. Employment with a prospective employer may be at-will where permitted by law and subject to the employer’s applicable agreements and policies. This statement does not establish or modify employment terms for Actus staffing employees.
To the extent permitted by applicable law, Actus is not responsible for decisions made independently by prospective employers or for indirect or consequential damages arising from the use of its recruitment services.
Actus may update these Terms periodically. Updated Terms will be posted on our website, and additional notice or consent will be obtained where required by applicable law.
11. SMS Communications and Consent
SMS Program Description
Actus may send SMS messages regarding job opportunities, recruitment updates, interview scheduling, application status, and related recruitment services.
Where separately authorized, messages may include promotional or marketing communications.
Consent
Consent to receive automated or marketing SMS messages is voluntary and is obtained through a separate opt-in process.
Acceptance of these Application Terms & Conditions does not constitute consent to receive automated or marketing SMS messages.
Consent to receive marketing text messages is not a condition of applying for a job or receiving recruitment services.
Message Frequency and Charges
Message frequency varies based on recruitment activity and communication preferences.
Message and data rates may apply according to the applicant’s mobile carrier and service plan.
Opt-Out
Applicants may opt out of SMS communications at any time by replying STOP to a message.
After opting out, applicants may receive a final confirmation message. No further messages will be sent under the applicable SMS program unless the applicant provides renewed consent or another lawful basis applies.

Privacy and Information Sharing
Mobile information and SMS opt-in consent will not be shared with third parties or affiliates for their marketing or promotional purposes.
Authorized messaging service providers may process mobile information and consent records solely to deliver and administer Actus SMS communications.

12. Electronic Agreement
By selecting the checkbox indicating acceptance of these Application Terms & Conditions and submitting an application, the applicant acknowledges having reviewed and agreed to these Terms.
Consent to receive automated or marketing SMS messages is separate and optional.
